statutes of temporary divorce hearing

I went to a tmporary Hearing for custody in Oct of 1996..My Husbands attorney never filed the papers in the court.I was told by the Judge that I was not to leave the county with my son.This statement he made was off the record. I need to know if I can re-file for a divorce and custody now after 4 yrs and no divorce. I need out of this county because of the demographics, they are not suitable to supporting my son and myself.I need to know what I need to file or can I just leave..What are the statutes on this situation? Thank you for your help

Re: statutes of temporary divorce hearing

If no divorce has been filed and no temporary orders have been signed by the judge, you are free to leave the county anytime you want. What the judge says on the bench is not an order until signed.
