Statutory Rape

My friend moved in with his current wife when she was 13 and he was 24. She now wants to divorce him and take the kids and everything. They have been together 16 yrs. She is threatening him with filing charges for rape when she was 13. He is afraid she can do it. Can she file charges when they have been married and together for 16 yrs?
