Can a step mom file for custody of a child that the biological mother and father have joint managing conservativeship if the biological father (and current husband of the step mom) is not taking his parental rights because the biological mother is making it too difficult?

No. The father needs to act. If he does not take advantage of his visitation or access to the child, that is his decision.
