The TX Family Code does not address this issue.

I could write a volume on this topic.

Here are a few broad thoughts.

I would have to meet with you & get details in order to address the facts of YOUR case.

Generally, corporal punish is frowned up by judges.

A "swat" by a parent is ok.

Hitting a chid with an object is never allowed these days.

Hitting a child repeatedly is discouraged.

Leaving marks is considered child abuse.

Generally, step-parents should not be physically hitting kids.

One swat is not going to cause a judge to "punish" a step-parent.

Was the child about to run into the street?

The facts would determine a lot.

Does the step-parent hit the child with a belt or spoon?

These days, judges don't like this - by bio parents or step-parents.

I hope this helps you a bit.

If you need to know more, I highly recommend meeting in person with a family law attorney and discussing the particular issues of your case.

I recommend attorney Patricia Bushman at 713-807-9405.

Please tell her that I sent you.

I rent space in her office.

I no longer litigate. I only mediate.
