Step -parent adoption

husband wants to adopt daughter. biological father is not on birth certificate and hasn't had anything to do with her at all. what do i need to do? can i just change my daughters last name?

A step-parent adoption is actually 2 lawsuits.

First, the paternity of the biological father need to be removed. Second, the step-parent adoption occurs. It is a slow process. If you cannot find the father, you will be required to pay for the attorney to represent his rights. Then there is an attorney appointed to represent the interests of the child. There is also a social study and a criminal background check of the new father.

Schools make the child use the name on their birth certificate. Therefore, just changing the child's last name wont' work.

Sorry, but it is an involved process. Adoption requires termination of the rights of the biological father and must be in the best interest of the child. An attorney for the biological father will be appointed if you can not find him and probably an attorney will be appointed for the child. A social worker will have to make a social study. You will need a local lawyer to assist you with this. I am not local to you, sorry.
