Legal Question in Family Law in Texas

My step son has always lived with his dad, up until he went to germany with the army, during that time he stayed with my husbands mother. Now the mother wants him back and she is living in a shelter with no means of supporting him. The army will not allow him to live with us until we have custody papers, we are in the process of saving the money up. If she goes to the attorney general and puts my husband on child support can we fight that in court, and get full custody at the OAG court?
