Legal Question in Family Law in Texas

as a step-mom what can i do to retain my husbands children in the event of his death? the mother lives in Kansas and rarely sees or speaks to the children. i do Not want to take away her visitation rights, i just want to retain my husbands custody.

Do you think you will have the mom's cooperation with this? If so, a good family lawyer should be able to handle both the family law and probate law aspects of the situation, without a great deal of expense. If you believe she will oppose it, then it is important to discuss all of the options with an attorney. Without her cooperation, it may not be possible to accomplish what you want, but then there may be compelling circumstances that would create the exception, rather than the rule.
