Step=parents

I need to find the legal definition of the relationship regarding a step-parent. Does the step-parent have to adopt the child to be considered immediate family, or does the fact that they are a primary caregiver make them immediate family?

Depends on what purpose you are evaluating this for.

Usually this question arises to ask whether a step-

parent is one of a step-parent's "children" in a will.

It depends on how children are defined in the will,

but unless specifically included, step-children would

not be considered children. Being the primary caretaker

will not cut it for legal purposes in a will, however some

other entities such as schools sometimes view this

differently.
