In Texas is a step-parent a legal gaurdian? Can a step parent give spankings to children 7 & 10 as a form of punishment/

No a step-parent is not a legal guardian. Any parent who spanks a child and leaves a mark is wide open to abuse allegations. A stepparent has no business spanking - and if I were involved as an attorney for the opposing party it would not be difficult to get restrictions on visitation based upon proof.
