Legal Question in Family Law in Texas
my stepson is married. Two years ago his wife cheated on him and got pregnant. my stepson put his name on the birth certificate. about a year ago she cheated again and left with new boyfriend and is now pregnant again.my stepson has taken care of his daughter on his own with very little contact with the mother. a month ago the mother took her daughter from the babysitter and he hasn't seen her since. I am considering helping him pay for a lawyer for a divorce. he is frustrated and wants to fight but also mentioned just letting her go. my question is since his name is on the certificate and he's taken care of her for 2 years. does he have the choice to just say I'm not the biological dad and walk away without the responsibility of paying child support?

He can deny paternity in connection with the divorce - in the petition, he mentions the child (children) born during the marriage, but states that the child is not his, and asks the court to order DNA testing.
