can stop my husband from gambling all his 401k up and what rights do we have to each others monies

You can file for divorce, ask for temporary orders to stop his spending and then get 50% of his 401k that was accrued during your marriage.

Otherwise, adults are allowed to do "stupid" things.

If he is mentally incompetent you would need a guardianship over him. Not easy to do.

You would need a probate or guardianship attorney to assist you in this matter.
