Legal Question in Family Law in Texas

Stop Order on child support garnishment

My Daughter turns 18 in two months, and graduates from high school day before her birthday.Per divorce degree child support is to stop at 18 years of age and high school graduation. Now my employer states they need a Stop Order or they will not stop payments.Called the court house and was informed everything was in the original order for it to stopon her 18th birthday but I may need an attorney to get the stop order signed by a judge and sent to my employer.

Is this really all needed? Can I do this myself ?

Is it so complicated ?Should I not be able to show proof and be done with it?My employer is really adamit they will not stop with out the court order. Is there an easy way to get a court order to stop child custody garnishment?

Re: Stop Order on child support garnishment

Give your employer a certified copy of the withholding order, together with a copy of her birth certificate and graduation certificate. The order should clearly state that child support terminates at the conclusion of the month of delivery of those items.

If he still refuses, ask a lawyer in your area to file a motion for termination. It should be fairly inexpensive.
