Legal Question in Family Law in Texas

subpoena in custody cas

I am a pediatrician and have

been subpoenad to give a deposition in a child custody case. I was only contacted about this through the subpoena, no personal contact.

Am I required to go and can I be asked to be reimbursed for this. I do not want to be involved and I do feel I would have any relevant input

Re: subpoena in custody cas

Read the subpoena. I don't think it gives you a choice of whether to go or not. You are entitled to a witness fee of $10. Your feelings of what you think is relevant are not important. For some reason, the attorney thinks you might have relevant testimony. If you wish to contest this subpoena, you should hire a lawyer. You might get the opportunity to testify when it is convenient for you on the day of the hearing rather than show up at the courthouse at the time directed in the subpoena and wait for hours to testify.
