Legal Question in Family Law in Texas

Subpoenaed in Family Court

I am being subpoenaed in a friends divorce. It is over the custody of the child. The incident I am suppose to testify about happened when I was 16 years old. The mother was doing illegal things in front of the child and I witnessed this. I am now 19 years old. Can they force me to testify considering I was 16 at the time and around illegal things? Will I get charges brought against me, if I was involved with the illegal things? Thank you for any response I receive.

Re: Subpoenaed in Family Court

You can refuse to incriminate yourself. Although it is unlikely you would face charges for something minor, it is still a risk. If the activity rose to the level of a felony, and you were involved, your risk of facing charges increases significantly. Consult with an attorney that has experience in both criminal defense and family law. Many offer an initial consultation for no charge.
