Subpoenaed - But I'm Out of Town! What now?

I'm a foster parent and will soon be subpoenaed in a lawsuit between child protective services and my foster childrens parents. I have plans to be out of town for 3 days conflicting with the court dates. Am I required to cancel my plans to be in court? Can the court date be delayed because a witness is out of town? What are my rights?

Contact the person that subpoened you and let them know that you plan to be out of town. Perhaps they can re-schedule. Since they want the court to hear your testimony, I assume your testimony is going to be important to the case. If at all possible, try to be there.

Technically, if you do not appear, the court can have you taken into custody and brought to court to testify.
