Sued over cutting daughters hair

I was sued by my ex for cutting my daughter's hair last year. After a month and a half of letting my daughters hair stay in her face, I decided to get it trimmed (out of her eyes...nothing drastic). Upon returning my daughter to her mother, she screams and tells me that she has been trying to grow it out, yet I was never told of this. I agree not to touch her hair. Then three months later I get sued by her accusing me of cutting her hair twice more since that incident, which I did not. We have gone to mediation and that has not worked. I am ready to just go to trial over this absurd issue because I'm tired of it and to get my lawyer fees back but I am afraid that I might lose. I know you never know in a case how a judge will rule, yet can a judge really say that I don't have the right to cut my daughters hair? And also, because she brought the case to court, make me pay her lawyers fees? I need some advice on this one. Oh, and I also have a tape recording of the confrontation with my ex and her husband when we DID cut her hair in which he treatens to kick my ass. They also admit on the tape that they didn't tell me that they were trying to grow her hair out. Please....I need some advice on what to do. Thanks!!

I wish you were in Collin or Dallas or Denton County, because what an excellent case to take to trial! It is amazing to me that this case did not settle at mediation. I would be very interested in seeing the mediation report. Hire lawyer. I seriously doubt that she would get atty fees, but you might.
