Legal Question in Family Law in Texas

being sued in small claims

I am a senior citizen and I was forced to hire an attorney to get rights to see my grandchild. The case has been dismissed. Today I recieved a paper where the party that has my grandchild is suing me for 2150.00 Reimbursement of a fee that theyt paid their att. I was pushed into a corner and had no other alternative, but to hire an attorney. They would not let him visit us for 2 and a half years. His father my son, is deceased. There was no one on my side of family to intervene on his behalf. People were relating to me that they were on drugs and leaving my grandson alone for hhours I had no choice but to hire an attorney. Do they have the right to take me to small claims court? They didnt have to hire an attorney. They could have just agreed for me to see my grand son and I would have dropped the case. Thank you

Re: being sued in small claims

Do they have the right? Of course, they have the right. That's what our system is all about. Do you have the right to appear and contest their claim? Of course you do. Tell the judge what you wrote right here. You have a very good chance of prevailing - perhaps without an attorney. Some evidence is the fact that the judge in the prior case did not award attorneys fees - did he?
