Legal Question in Family Law in Texas

Summer visitation

My ex-husband and I have joint custody of our 2 children (11 & 7 y/o). In the decree it states he has to give me written request by April 1 as to what days he would them. If not, then he automatically has them 30 days in July (07/01-07/30). My question is if during summer possesion does he or loose our weekend possesion? For example, if he has them in July does that mean I don't get them for a total of 30 days and vice versa?

Re: Summer visitation

You need to read your decree carefully. Normally you get at least one week-end during his month to see th kids. If he takes the kids to Colorado, then you would pick up and return the kids to Colorado.

I guess I don't understand your question. He gets them for 30 days and you should have the option to cancel one of his summer visits so that you too can take the kids on a long vacation.

If you don't understand your decree, then you need to meet with an attorney to explain it.

Of course, if the 2 of you come to your own agreement, you guys can do anything you want to do.

The court ordered visitation is the minimum that he will see the kids when you can't agree to visitation.
