Legal Question in Family Law in Texas

Summer visitation - fail to notify by June 1st

My ex-husband has not notified me of which weekend he wants to take from my extended summer visitation by the June 1st deadline. The paragraph only states that if he gives me notice by June 1st that he gets to pick a weekend that would ordinarily be mine. It does not say what happens if he does not give notice. Does he lose this weekend?

The purpose of the notification provision is to give people the ability to plan ahead. If he fails to notify you in time then he has given up his right to demand that visitation.

I tell most of my clients, however that they have to live under their visitation schedules for a long time. Even if the visit may not be "demanded" it is usually a good practice to find another accomodation, perhaps on a different weekend. I can assure you that there will come a time that you need such an accomodation and it would be nice to feel comfortable that you have a reasonable shot at it.

Of course, some situations are so devisive that you need to follow the decree explicitely. I hope that yours is not that way.

Good luck.
