Legal Question in Family Law in Texas

Summer visitation

My ex moved out of state over a year ago. Over most of that time, he has refused to give his son (12 years old) his phone number or address. He moved to IN from MO and wouldn't even admit at first that he was living in IN. He always called from a blocked number until I had anonymous call block added to my phone. We just recently got the phone number and address when the new wife wrote my son a letter. His dad didn't even know his wife had written the letter until my son mentioned it. His dad then got mad that his wife had given us the information.

I have only gotten child support sporadically in the last year.

Last summer my son went to visit his father and there were problems in getting my son back. I had to drive over halfway to get my son. Now, the ex is wanting my son this summer. The ex's mother is supposed to pick my son up and drive him to the other state (IN). As of right now, all I am told is they will put him on a plane when he is due home. They haven't purchased a ticket or anything.

What can I do to prevent him from going to IN?

Re: Summer visitation

Get an order from the Court. You've just about waited until the last minute. You could require your ex to post a bond in order to have visitation. You should get an attorney for this job and since you've waited until the last minute, be prepared to pay a premium - or worry all summer about whether your child will be returning from IN.

I completely agree with Mr. Grissom, and would also say as a parent and as a lawyer, you need to do this immediately. Under the circumstances you describe, I would not send my child. The new wife might be a decent human being, but she is clearly not in charge of the situation.
