Legal Question in Family Law in Texas
When is supervised visitation necessary
1 Answer from Attorneys
Supervised visitation is a narrow alternative, and is very fact-specific. In general terms, it is applied when unfettered access to a child is not in the child's best interest, but does not rise to the level of qualifying as a termination. Generally, it is invoked when a parent has a history of sexual abuse, physical abuse towards the child, criminal convictions of a nature that renders the parent untrustworthy, evidence of abuse or neglect of the child, repeated violations of reasonable parenting - i.e. alcohol or drug use etc. If you believe that a parent's possession and access should be supervised, discuss the specific facts with an attorney in that jurisdiction. Some issues will vary from county to county and judge to judge.
