Support when each parent has a child

Is anyone responsible for child support when each parent has custody of 1 (of 2) children?

One parent makes 100K per year and lives in Texas and the other parent makes 20K per year and lives in North Carolina.

If the legal custodial parent does not change the legal paperwork to give the other parent legal custody, are they still reponsible for support payments?

Your question is extremely complicated. I cannot answer it without additional information.

Generally speaking, you look at the state law in the state that has continuing jurisdiction in this case. I don't practice law outside of Texas so I cannot comment on another state.

If neither of you are still in that state, it gets very complicated. I won't attempt to answer it here.

If the case is in Harris County, Texas, my answer would be child support is calculated for both parents at 20% of their net income (as determined by the State of Texas). If the figures are not identical, the one that makes the most pays the difference of the 2 figures to the other parent.
