Legal Question in Family Law in Texas

Takeing Parental rights away

How long do you have to wait before you can take someones parental rights away? And how would a person go about doing it.

The reason why I am asking this question is because my ex husband has not seen my daughters in over5 yrs.

Re: Takeing Parental rights away

In Texas, there have been cases in which the court recognized abandonment and terminated a parent's rights after a few months. One thing to be careful of is child support. Once a parent's rights are terminated so are his or her responsiblities. This may not always be in the best interest of the child. Nonetheless, to proceed with terminating parental rights, a lawsuit should be filed. This can become complicated especially if the suit is contested.
