Legal Question in Family Law in Texas
taking kids away from there drug addiction mother
CPS has already removed the kids from there mother & two different people have guardianship over these kids & she is pregant with another baby now & has tested postive for drugs, her brother & his wife that live in Florida want to adopt these two kids & CPS had told them to call a lawyer so I need to know how I can go about adopting my niece & nephew to get them out of this drug infested home. The mother is getting 640.00 a month SS on the boy & 400. child support on the girl & she don't want to give up the kids because she needs this money for drugs & she don't have either of them living with her.

The situation you describe is complex, but not impossible. The potential parents need to retain an attorney in the county where the action is pending. They will need a social study completed. The attorney needs to work with CPS to first arrange temporary placement.

You need a lawyer in the Galveston area. This can be done and done rather quickly. It's going to cost some money. CPS or the State of Texas will not pay for it. Find yourself a lawyer and save the kids.
