Legal Question in Family Law in Texas

Teen mother supporting baby

My daughter had a baby at 16. The fathers name is on the birth certificate, but the child carries the mothers last name. The parents are not together and in the last 2 monthes all the father has contributed to the baby is a bag of diapers and 12 jars of food.

He now wants to file for custody of the baby. Can he do this? He just turned 18. Also, can he be charged with statutory rape his whole family wanted an abortion from the start and I just can't see them even deserving visitation.

Re: Teen mother supporting baby

There is a lot more information that I need to answer your questions. The child's age, whether the father signed an acknowledgement of paternity, how long the child has been in your daughter's care, how long the biological father has been away from his child...are all questions that will have an effect on his options and yours. If he is filing for custody of your daughter's child, I recommend that your daughter retain an attorney. I will be happy to assist you further. If you are in the Dallas-Fort Worth area please call me at 817 763 0600.
