Legal Question in Family Law in Texas

Telephone Calls

My son is living with his father. We are going back to court soon for me to try & gain custody of our 12 year old son.

My question is: I have tried calling our son for almost two months now, but I'm told by his new stepmom that he's not there, he's outside, or the line just stays busy for hours on end.

Do I have ANY rights regarding calling my son?

Also, I recently found out that our son has missed 19 days of school this year. I got a copy of the school records, which my ex husband does not know I have.

My son has been told by his dad that he might fail because of his grades, but I averaged all his grades & he is currently passing every subject.

I want my son here where I can take proper care of him, he's being neglected.

And more than likely he's being told I never call him.

His new stepmom told him to call HER mom even.

How do I know that he is ok without talking to him?

Please HELP.

Document your efforts via phone calls where you tape yourself leaving a message or send letters via certified mail, return receipt requested. Ask for them to allow him to call or for you to call him. Then once you have your efforts documented, file a Motion to Enforce in the court where you received your divorce decree. I hope this helps.
