Temporary Child Custody

Our niece has gotten herself a DUI and may have to spend some time in jail, she has two daughters ages 3 and 5. Their father is deceased. She wants to have a document that states if she has to do time the girls will be in our custody for the duration of her jail time. Do we need to have a specific affidavit signed or can we use a notarized letter?
