Temporary Custody Now Won't Release

We of 8 yrs had a non-violent (he has never hit us) domestic dispute after hubby arrived home intoxicated from the Company Christmas Party. My girls 12 & 14 @ Aunts for the weekend and heard one small spat. My marriage is good, just a disagreement but at the time I wasn�t sure what was going on and did not want the girls to deal with the stress ~ We don't fight! Just had to much and it was a verbal blow up. NCP wrote the agreement & included seperation, pending divorce! Never my intentions! I was thinkin of the girls! It was notarized for undetermined Temporary custody so hubby & I could figure it all out. I read that it is not a binding document correct? 7 days later I called ~everything was great & a complete misunderstanding, but he refused release! He hates my hubby & wants me back, says unsafe since I am still married. He resides in OK. DA won't file anything! NC had them so upset after Thanksgiving they were very defiant and hateful, never seen that from them, head games?! What can I do? Our home is very stable with routine. Does it really take 120 days to get this heard in court on the Corpus? Can you explain the Writ? Refused Christmas & refuses to answer my calls. Please advice! One month now. Need advice

You need to see an attorney immediately in the county where the document is filed.

I cannot explain the writ.
