Temporary custody

My sister moved out of state and left her husband 6 months ago. She hasn't had a stable home since and she sent me my niece for the summer. My niece is all mixed up because her mother stays her and there and leaves her with other people. She really wants to stay with me and go to school with my boys. What do I need to do to get temporary custody of her until my sister decides to get her life strait? I don't want to take her away I just want her to have a stable home ( by the way she is only 6yrs)

You need to have possession of the child for 6 months to have "standing" to bring your lawsuit.

You need to hire an attorney immediately.

If the parents have filed for divorce, that is the court of continuing jurisdiction.

You will need to serve both parents that you want custody.

If neither parent wants the kid, then they can agree to you having custody.
