Terminating Ex's rights

How would I go about having my ex-husband sign over all rights to my two young daughters? He has never paid child support, and hasn't seen them in over two years. He was just released from a year in jail for drug possession charges.

You would file a petition for termination of the parent-child relationship. Your ex would either agree to it or contest it. An ad litem would be appointed for the child to determine whether the termination was in the child's best interest. If the ad litem agreed, and the judge agreed - a court hearing is necessary even if everyone agrees - then termination would be approved.

Most judges would not approve a termination of a dad's status/rights unless there is a stepdad willing and able to adopt the children in question. The general thinking is that it is not in the children's best interest to allow a termination without an immediate adoption.
