Legal Question in Family Law in Texas

terminating parental rights

My friend is going though a divorce and currently is seeking full custody of all four of his children which live with him at the moment. The mother is threatening to give up her parental rights because she dosen't want to pay child support and she has very little contact with the children. Can she do this?

Re: terminating parental rights

Not very likely. The court will impose child support based upon her ability to pay. Just because she doesn't want to pay is not a sufficient reason to any judge not to order child support. Lack of contact is also no reason to terminate parental rights.
