Legal Question in Family Law in Texas

Terminating Rights

My 4 year old daughter lives with me in Texas and her father lives in Illinois, we were never married. My daughter and I have lived in Texas for 3 years. I had an order of protection on him when we lived in IL. Out of his 5 children 2 of them have child support filed against him. I want to just be able to terminate his rights, what is the process to do this on my own?

Re: Terminating Rights

You can file a suit to terminate his rights as a father. The courts are reluctant to do that if there is some hope of having him pay child support because the termination order cuts off his obligation to pay for the support of the child.

I suggest you contact a board certified attorney for assistance.

Re: Terminating Rights

Trying to terminate his rights is not a DIY kind of case. Even with an attorney, your chances of getting the termination are slim and none unless there is someone (a stepfather) who is willing to take on his responsibilities. Why don't you go after him for child support? Either way, you need a good family law attorney.
