Termination and Adoption

A father has signed the necessary documents to voluntarily terminate his parental rights to his daughter and has also had the documents drawn up for the step father to adopt her. This is in the best interest of the child.

Since the mother and step father have been together since September 2000, will a home and social study be ordered? Is it necessary? Also, how high is the likelyhood that the judge will deny the petition?

First, I assume that you have an attorney helping you do this. If not, I would strongly urge you to hire one immediately. A step-parent adoption is not hard but you must jump through the right "hoops" to get it finalized.

In Harris County a social study must be done. It is not expensive or time consuming. The step-father must also have a criminal background check done by the police. Again, not expensive or difficult -- but another hurdle to jump.

I also assume that you have a guardian to represent the child.
