Termination of parental rights and adoptive parents

My daughters father wishes to terminate his parental rights, he is delinquent in child support and does not excercise his visitation. Although I am remarried I do not wish for my husband to adopt my daughter. Can my ex-husband still terminate parental rights if there is not someone waiting to adopt her?

Yes, he can relinquish his parental rights if you agree. If you do, he will no longer be legally liable for child support.

There is no legal requirement that there be someone wishing to adopt the child as a prerequisite to father's relinquishment.

He cannot just decide to do this on his own, however, as a device to defeat his child support obligation, and relinquishment to be effective must be carefully done and in most states approved by a judge before it is effective.
