Termination of parental rights

My daughter was beat up by her father when she was 3 months old he was put in prison for injury to a child and now he is sending letters to my family members trying to find me i am married and now and very scared of my x i thought that because he was put in prison he doesnt have any rights over my daughter but im not sure if he does how do i terminate his rights while he is still in prison? I am afraid of what he will do to me or my daughter if he does have rights please help.

I presume he has not paid child support for more than 6 months and that he has not made any efforts for visitation (obviously). These are grounds for termination of parental rights. You should have started earlier. If he is getting out now, he could possibly try to exercise his parental rights. But, do something now. Find a lawyer who will help you and take payments. Perhaps a Women's Support Group in your area, some counties have bar associations who offer legal services for free. Find out what is available in your area and get to work.

First, try to make it hard for him to find you. I would not have any utilities in your name. I would use a post office box for all mail.

Put a "flag" on your credit report that you are worried about identity theft.

In other words, try to "disappear" as best you can.

I assume that your family is not reponding to his requests.

Has he established his paternity? If not, then he has no more rights to the child than a stranger.

I'd go visit an attorney for a consultation.
