Legal Question in Family Law in Texas

Termination of Parental Rights

I am looking into giving up my parental rights to 2 of my children. I am trying to find out the average cost including attorney fees for this. Also, the child support order was issued in Texas. I am currently stationed in Ft. Campbell, KY but deployed in Afghanistan at the time. If I was to hire a lawyer, would I have to be at the court hearing? Your assistance is greatly appreciated.

Re: Termination of Parental Rights

The court in the county of residence of the children would probably have jurisdiction over a termination case. Under Kentucky law, a court may not issue an order, voluntarily terminating a parent's rights unless the other parent has remarried and the new spouse agrees to adopt the child or children.

You and the mother of your children may not like each other, but Kentucky law (and I understand most other states have similar laws) requires you to provide support for your children until they are emancipated or until another responsible adult agrees to adopt and support your kids.

You are best advised to seek the services of a competent Kentucky attorney. You can telephone your local bar association for a referral, or can find a good lawyer on-line at the Kentucky Bar Association's Lawyer Referral Service:
