If your ex has been asaulting your child it is a criminal matter. Call the police and child protective services. You don't need a form - you need a lawyer - and the DA. Get help soon.

To add to what the other attorney wrote, you need to document everything!
I'd have my child at her pediatrian on Tuesday morning and have him give her a complete physical.
As a mother, I would not be worried about contempt!
You need to protect your child!
Medical personnel (emergency room and physicians) are required by law to report child abuse.
Get on the phone and find a lawyer asap.
You need a modification done as soon as possible.
A judge must sign the document in order for you to get legal custody.
Your husband can sign anything he wants but it is not legally binding.
Best of luck!
