termination of rights
My question is my 8 year old son's father has not seen him since may of 1998 and stopped paying child support aug of 1999,although there is a court order, how would i go about terminating his rights? In total my son has seen his biological father about 10 times in 8 years, if that. I am now married to a wonderful man who would like to adopt my son and my son wants him to also.

You seem to have grounds for terminating the biological parent's rights. However, if you terminate the parental rights you may terminate your right to child support and the back child support with interest. If you are not sure if you want to terminate the rights, you may seek to have the court order enforced. The penalties for failing to follow a court order include a $500 fine for each violation and/or imprisonment.
