Termination/Child Support
I have a 5 yr old son- father lives in another state - has only seen about 4 days a year for the last 3 years - we have an agreement between us for child support - he is behind almost 7k - says he is moving here to now jump back into his live - dont know when - says he is going to pay all back child support - dont know when - says he wont terminate his rights so that my husband who has been raising him for the last 3 years can adopt - what are my options?

You might be able to use these facts to involuntarily terminate the father's rights to show that it would be in the best interest of the child to be adopted. I kinda doubt that the judge will terminate ,but sometimes if it's for an adoption, they might. Good Luck.

Your profile suggests a number of alternatives. If he is serious, you might be able to entice your ex to voluntarily terminate his parental rights in conjunction with a step parent adoption. Such would eliminate any future child support obligation and you could offer to waive the arrearages if he would voluntarily sign the termination papers. If he refuses, you should bring an enforcement action against him and vigorously pursue it. I have handled cases such as these on a number of occasions.
