Legal Question in Family Law in Texas

I am in texas. My child was sick and missed some school. I had dr. Notes for most days out sick. There were a few times were when she had lice she got from her classmates I kept her out to freat the lice but did not get a dr. Note for that and a couple days when I had family emergency and had to keep her home.

I was planing on moving from tx to va. The land lord here is fileing bankruptcy and I will have to move soon and I currently just ended a long term relationship. Me and my daughter have a apartment ready for us in VA. We have family there and I am going to enroll her in school there upon our arrivle.

We were suppse to leave on the 1st but now the school is takeing us to court and we have a date on the 13th. They are saying I contributed to her abcenses and I have to go to court. I am on a limited income as I left my job planning on the move. I had al plans to leave on the 1st. What are something I sent in a letter to the judge explaining but they say they will get back to me later past the date of my intended move. I called the super indendent of schools and he said to just go if I habe to and if I am not here and my daughter is disenrolled the school wont continue with the case.

But I dont know if I can trust that. Staying ti the 13th will put us under a hardship as we need what we have to move and get set up in va. Once in va we will he ok we have an appartment to move into and have family there.

What are my options.

It's hard to say - it makes sense that if the child is disenrolled and moved out of state, that the case would be dismissed. There is also no guarantee, and you certainly don't need an additional problem for a failure to appear. Consider going to the school and see if they will allow a disenrollment for a future date certain when you are leaving. Ask them also to provide you then with a dismissal note from the court. If you do not get that within a few days, consider contacting the court and asking that the case be held telephonically. This is likely in JP or municipal court - talk to the clerks there if it is not dismissed immediately.
