Legal Question in Family Law in Texas

In Texas, does can child support modification be applied to back years? My husband has been paying his child support for 17 years. The mother never filed for modification. Now she is threatening to file for modification and to get back money since he has been making more money for several years. (She is not in need of the money and makes more money now than when she first filed for divorce).

The simple answer is no. Any increased amount of child support ordered in a modification action can only go back retroactively as far as the date of either service of the modification actin on the Respondent or the date the Respondent makes an appearance in the modification action.
