Legal Question in Family Law in Texas
In Texas, our daughter is now 18 and still in school. She is very abusive and disrespectful. She drives her mothers truck and stays out all weekend. She also has two horses in her name, but my wife and I must pay for the food and feed them. We tell her we may call the SPCA to come get them if she doen't help out with the care and feeding and she threatens to sue us if we do. Where do we stand as far as our rights vs hers please.
1 Answer from Attorneys
The moment she turned 18 she became an adult.
She is now 100% responsible for herself.
She owns the horses. They are her responsibility. If she does not take care of them she can be charged with animal cruelty.
You probably need to talk to an attorney about your rights.
You can call the SPCA about her responsibility since she owns the animals.
Congratulations - now that she is an adult you are not responsible for her any longer.
She can threaten to sue you. But you would be able to defend yourself in court. The judge would determine who wins.
You can also call your local sheriff, constable or police and get their opinions about any of this.
If you don't want her in the house any longer, you can evict her. Go to your local small claims court and begin the process. It's easy.
Being in school is irrelevant. She's an adult.
