Legal Question in Family Law in Texas

Texas: My husband is filing custody for his 15 year old son. The mother is the custodial parent with the primary rights of the son. We have the son for the summer and due to take him back before school starts. The mother is aware of the custody battle because she got served on yesterday. Can we keep the son here in Texas with us until the court hearing and so that he could talk to the judge at the end of this month? Will my husband be charge for contemped court or kidnapping? Please advise.
