Texas Infomral mariage

I was engaged to be married in 1998 and moved in with my fiance. After a few months, I found out things about him and called off the engagement. We live as roommates, but he calls me his wife to others. I refer to him as my boyfriend, but roommate would be more appropriate. I suspect he is trying to establish a ''common law marriage'' so he has legal claim to any inheritance I may come into. I use my last name, not his. We do not file a tax return as husband and wife. We do have a joint checking account, not with the same last names. Are we considered legally married?

The only factor in your favor appears to be that you do not represent yourself to be married, but you allow him to do so. You would be wise getting a new roommate and definitely stopping him from telling people you are married, or you will only have yourself to blame.
