Texas laws regarding CPS

My husband are I considering seeking custody of his 12 year old daughter. His ex-wife is emotionally unstable, and has already lost custody of her youngest daughter to her father.

I was wondering if there are specific laws regarding whether or not Texas CPS will step in at a specific number of police calls to the house. The police have been called 4 times, 3 for domestic violence charges, and once for a screaming argument between the mother and the oldest daughter. All 4 calls have been within the last year.

In general, CPS only responds on cases in which a referral has been made to their agency through the hotline number. The department then makes an investigation and takes whatever action is deemed necessary. They don't really have the authority to go out and look for problem situations. Of course, the police have the ability to contact the agency in emergency situations, and each office is required to have a caseworker on call at all times.
