Legal Question in Family Law in Texas
In texas, a mother (father not involved) lives with her parents and is nearly 30 years old. She has mental instabilities (bipolar-unmedicated), and has recently started to only come home once every couple/few days leaving the grandparents to care for the child. She does not communicate she will be gone and just leaves for days on end. The grandparents do not want her to live with them anymore as they suspect drug abuse (reoccurring past issue). If she were forced to care for the child she has been known to keep him out into all hours of the morning, most likely at questionable places, in an inappropriate environment with drugs, etc. Are there grounds for the grandparents to petition for custody? What proof is needed? How you do prove she neglects to care for the child without putting the baby in danger?
