Legal Question in Family Law in Texas
In Texas ...
Mr and Mrs A have been married 28 years. Mr A moved out of their home (in July) and filed for divorce. Mrs A subsequently discovered "HARD" evidence of infidelity to include payment to prostitues. During divorce negotiations Mr A wanted Mrs A to sign confidentiality statement. Mrs A has evidence that Mr A paid prostitutes with checks and wrote checks off Taxes as "non-employee" business consultant (IRS crime).
Question: If Mrs A signs confidentiality statement can she report Mr A's IRS activities to IRS without breaking confidentiality statement?
1 Answer from Attorneys
Only an attorney who had read and reviewed the confidentiality statement, the court order, and the after-acquired evidence; would be able to advise you. You would also need to consult the attorney regarding the tax consequences, if any, of reporting the information; as well as the confidentiality of reporting to the IRS>
