Legal Question in Family Law in Texas
texas parental consent laws
I live in Michigan my ex husband lives in TX. I filed in MICH and he is behind $42,000 in child support. I haven't heard from him in 5 years until yesterday. We are scheduled to go to a hearing tomorrow because the court wants to put out a bench warrant. he says he is willing to give up his rights and let my husband now adopt my children. From what I understand he has to sign the paper work in front of someone who can witness oaths. Exactly what kind of person can do that and how would I go about getting him to sign the paperwork in the right area.. where should I tell him to go? He is not going to the court hearing but wanted this to take affect tomorrow so he doesnt have to go to jail if i waive the back child support.. which i havent decided if i will do yet. but he is sending an attorney in his place tomorrow.. he cant afford child support but he can afford an attorney.. and is it possible that i can make him pay for the fees for him to go sign wherever he needs to so that it is legal when he sends the forms back?

If your ex is going to consent to an adoption, you'd better do it right. It is too important to leave to chance. Get a lawyer. However if you are insistent upon doing it yourself, get the court forms from the local bar library and have the papers signed in front of a notary. The fact that you are asking this queston however should cause you to recognize that you need a lawyer. William S. Stern 248-353-9400

He can bring the paperwork to a Notary Public and have the Notary place him under oath and verify his signing of the paperwork.
