Legal Question in Family Law in Texas
In Texas, is it best to get a Quit claim deed before the divorce is final?
1 Answer from Attorneys
Quit claim deed is usually worthless. I would encourage you to use an attorney to make sure that you get the right paperwork done NOW so that you don't have to spend thousands of dollars LATER to get it done properly.
I assume that you do not have an attorney in your divorce. If you don't you need one!
A home is probably your biggest asset. Don't try to save a couple of hundred bucks -- hire an attorney or you won't have a clean title to your property. When you go to try to sell it you might find out that no one will buy it because you cannot get a title policy or your ex will need to sign the paperwork -- if she won't sign the paperwork to sell the house then you are stuck!
Good luck!
