Since Texas does not recognize legal separations, can I buy a house without my mate?

You can buy a house any time you want to, and you don't need anybody's permission. However, if you are married at the time you buy the house, there will be a presumption that the house is the community property of yourself and your wife, and is owned jointly by the two of you.
